CRYPTOGYANI™ TERMS OF SERVICE

Welcome to CryptoGyani™! These Terms of Service ("Agreement") govern your access to and use of the services provided by CryptoGyani™ (referred to as "CryptoGyani™," "we," "us," or "our") through our website, mobile applications, and other online platforms (collectively, the "Services"). By accessing or using the Services, you agree to be bound by this Agreement.

1. ACCEPTANCE OF TERMS

By accessing or using the Services, you agree to be bound by this Agreement and any additional terms and conditions referenced herein, including our Privacy Policy. If you do not agree to this Agreement, you may not access or use the Services.

2. ACCOUNT REGISTRATION

You may be required to create an account to access certain features of the Services. When creating an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. ELIGIBILITY

You must be at least 18 years old and have the legal capacity to enter into this Agreement in order to access or use the Services. By accessing or using the Services, you represent and warrant that you meet these eligibility requirements.

4. LICENSE

Subject to your compliance with this Agreement, CryptoGyani™ grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal use.

5. PROHIBITED ACTIVITIES

  • Violating any applicable laws or regulations;
  • Using the Services to engage in any illegal activities, including but not limited to money laundering or terrorist financing;
  • Interfering with or disrupting the Services or servers or networks connected to the Services;
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
  • Collecting or storing personal data about other users of the Services;
  • Accessing or using another user’s account without authorization;
  • Reverse engineering, decompiling, or otherwise attempting to extract the source code of the Services;
  • Modifying, adapting, translating, or creating derivative works based on the Services;
  • Removing, circumventing, disabling, or otherwise interfering with security-related features of the Services.

6. FEES

CryptoGyani™ may charge fees for certain features or services offered through the Services. By accessing or using these features or services, you agree to pay the applicable fees.

7. INTELLECTUAL PROPERTY

The Services and all content, features, and functionality thereof are owned by CryptoGyani™ or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works based on the Services without CryptoGyani™’s prior written consent.

8. PRIVACY

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.

9. THIRD-PARTY LINKS

The Services may contain links to third-party websites or resources. CryptoGyani™ does not endorse and is not responsible or liable for the availability, accuracy, or legality of any third-party websites or resources linked to or accessed through the Services. You acknowledge and agree that CryptoGyani™ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or resources.

10. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CRYPTOGYANI™ DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CRYPTOGYANI™ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. LIMITATION OF LIABILITY

IN NO EVENT SHALL CRYPTOGYANI™, NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICES (I) FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), (II) FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE (REGARDLESS OF THE SOURCE OF ORIGINATION), OR (III) FOR ANY DIRECT DAMAGES IN EXCESS OF THE GREATER OF (A) THE AMOUNT PAID BY YOU TO CRYPTOGYANI™ FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY OR (B) $1000.

12. INDEMNIFICATION

You agree to indemnify and hold harmless CryptoGyani™, its directors, officers, employees, agents, partners, and suppliers, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of this Agreement, or your violation of any applicable laws or regulations.

13. TERMINATION

CryptoGyani™ may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination of your access to the Services, your right to use the Services will immediately cease.

14. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Pune Jurisdiction, without regard to its conflict of law principles.

15. DISPUTE RESOLUTION

Any dispute arising out of or in connection with this Agreement shall be resolved by arbitration administered by the ILS Centre for Arbitration and Mediation (ILSCA), Pune in accordance with its Commercial Arbitration Rules.

16. CHANGES TO THIS AGREEMENT

CryptoGyani™ reserves the right to modify or update this Agreement at any time, without prior notice. Continued use of the Services after any such changes shall constitute your consent to such changes.
